The Virgin Islands Internet Gaming and Internet Gambling Act of 2001 provides for the issuance of internet gambling licenses. There is an initial license fee of USD $25,000 for the first two years and an annual renewal fee of USD $10,000 thereafter. Licenses are permitted to offer sublicenses or to franchise multiple sites. There is also a one-time application fee of USD $10,000, and a surety bond of at least USD $100,000 must accompany the application. The tax rate for online gaming is 2.5% of gross revenue. The US Department of Justice has issued a warning to the Virgin Islands government that indicates hosting internet gambling sites violates US federal laws. The Virgin Islands law permitting online gaming does so only under the condition that it can be conducted within applicable laws, which the Casino Control Commission understands to mean both local laws and US federal law. There are no online gaming sites presently licensed in the jurisdiction.
